Earned Sick Leave

The Department of Labor recently released a FAQ relative to the Paid Sick Leave Act, which became effective for school districts on October 29, 2018.   The release from the Department of Labor has provided additional guidance and has resulted in the current opinion provided by our Attorney.  Accordingly, I recommend you review this new guidance and move forward to comply with the Act’s provisions.  It is clear from our attorney’s opinion that the Paid Sick Leave Act has sick leave benefit implications for employees not otherwise covered by a Collective Bargaining Agreement (CBA) or who are “steadily” employed and receiving benefits pursuant to 18A:30-2.
